These Terms and Conditions ("Terms") govern your access to and use of Smaplo, including the Smaplo mobile application, website, and related services ("Smaplo", the "App", or the "Service").

Acceptance of These Terms

By creating an account, accessing, or using Smaplo, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Smaplo.

If you use Smaplo on behalf of another person or organization, you confirm that you have authority to accept these Terms for them.

Eligibility

You must be at least 13 years old to use Smaplo. If you are below the age of majority where you live, you may use Smaplo only with permission from a parent or legal guardian.

You are responsible for making sure your use of Smaplo is legal where you live and where you use the Service.

Your Account

You are responsible for your account and for keeping your sign-in credentials secure. You must provide accurate account information and keep it up to date.

You may not share, sell, transfer, or misuse your account. Notify us promptly at smaplo@zohomail.eu if you believe your account has been accessed without permission.

Location and Safety

Smaplo includes social map and location-sharing features. You are responsible for choosing your privacy settings and deciding what location information to share.

Location data, maps, directions, nearby-user information, and event information may be inaccurate, delayed, incomplete, or unavailable. Do not rely on Smaplo for emergencies, personal safety, medical needs, navigation safety, or any situation where inaccurate information could cause harm.

Always use your own judgment when meeting people, attending events, sharing locations, or visiting places discovered through Smaplo.

User Content

Smaplo may let you create, upload, send, post, or share content, including profile information, messages, images, videos, audio, locations, groups, events, comments, reactions, reports, and other materials ("User Content").

You keep ownership of your User Content. You grant Smaplo a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, transmit, and distribute your User Content as needed to operate, provide, moderate, secure, and improve the Service.

You are responsible for your User Content and confirm that you have the rights and permissions needed to share it through Smaplo.

Community Rules and Prohibited Content

Smaplo does not tolerate objectionable content or abusive users. You may not use Smaplo to create, upload, send, post, share, request, encourage, or promote:

harassment, bullying, threats, intimidation, stalking, or targeted abuse;
hate speech, discrimination, or dehumanizing content;
sexually explicit content, sexual exploitation, or content involving minors;
graphic violence, self-harm instructions, dangerous acts, or credible threats;
illegal goods, illegal services, fraud, scams, phishing, or deceptive activity;
impersonation, fake accounts, misleading identity, or unauthorized use of another person's information;
spam, mass messaging, scraping, automated abuse, or attempts to manipulate the Service;
malware, harmful code, attempts to bypass security, or attempts to access data without permission;
content that infringes intellectual property, privacy, publicity, or other rights;
private or sensitive information about another person without permission;
location-based harassment, doxxing, unsafe meetups, or misuse of map/location features;
any content or behavior that violates law, these Terms, or another Smaplo policy.

Reporting, Blocking, and Moderation

Smaplo may provide tools to report users or content, block users, manage group membership, remove users from groups, or ban users from groups. You agree not to misuse reporting, blocking, or moderation tools.

We may review, restrict, remove, or disable access to User Content or accounts if we believe they violate these Terms, create risk, harm other users, or expose Smaplo or others to legal or security issues. We may use automated tools, manual review, user reports, or other signals to support moderation and safety decisions.

Groups, Events, and Meetups

Users may create or join groups, events, chats, or meetups. Smaplo is not responsible for user-organized events, user conduct, venue safety, event accuracy, or what happens before, during, or after a meetup.

Group and event creators are responsible for the content they publish and for complying with applicable laws, venue rules, and these Terms.

Third-Party Services

Smaplo may use or link to third-party services, including authentication providers, cloud services, maps, geocoding, image providers, backup providers, analytics, crash reporting, and notification services. Third-party services may be governed by their own terms and policies.

Smaplo is not responsible for third-party services, content, websites, or integrations that we do not control.

Intellectual Property

Smaplo, including its name, design, software, features, logos, and other materials, is owned by Vlad Calina and is protected by applicable intellectual property laws.

These Terms do not give you ownership of Smaplo or permission to use Smaplo branding except as needed to use the Service normally.

Copyright and Intellectual Property Complaints

If you believe content on Smaplo infringes your copyright, trademark, privacy, publicity, or other rights, contact us at smaplo@zohomail.eu. Please include enough information for us to identify the content, understand the claimed infringement, contact you, and review your request.

We may remove or restrict content that we believe infringes rights or violates these Terms. We may also restrict or terminate accounts that repeatedly infringe rights or misuse the Service.

Acceptable Use

You agree not to:

use Smaplo in a way that violates law or these Terms;
interfere with, overload, reverse engineer, copy, modify, or disrupt the Service;
access or collect data using bots, scrapers, crawlers, or unauthorized automation;
attempt to bypass privacy, security, rate limits, moderation, or access controls;
sell, rent, sublicense, or commercially exploit Smaplo without written permission;
use Smaplo to track, harass, monitor, or harm another person.

App Stores and Platform Terms

If you downloaded Smaplo from Apple App Store, Google Play, or another app marketplace, your use may also be subject to that store's terms, rules, and policies. The store provider is not responsible for Smaplo except as required by its own terms or applicable law.

Account Deletion and Termination

You may delete your account using the in-app deletion flow where available. Account deletion instructions are available at https://www.smaplo.com/delete-account.

We may suspend, restrict, or terminate your access to Smaplo if we believe you violated these Terms, created risk, harmed another user, or used the Service unlawfully or abusively.

Changes to Smaplo or These Terms

We may update, suspend, remove, or change parts of Smaplo from time to time. We may also update these Terms. If we make material changes, we will update the "Last updated" date and provide additional notice where required.

Your continued use of Smaplo after updated Terms become effective means you accept the updated Terms.

Disclaimers

Smaplo is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, security, and non-infringement.

We do not guarantee that Smaplo will be uninterrupted, error-free, secure, accurate, or available in every location or on every device.

Limitation of Liability

To the fullest extent permitted by law, Vlad Calina will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from or related to your use of Smaplo.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Vlad Calina from claims, damages, liabilities, losses, and expenses arising from your use of Smaplo, your User Content, or your violation of these Terms or applicable law.

Governing Law

These Terms are governed by the laws of Romania, excluding conflict of law rules, unless consumer protection laws where you live require otherwise.
